Environmental Protection Act 1990, Section 82
These proceedings are designed to allow tenants to force landlords to carry out repairs where properties are in such a condition so as to put health at risk:
Section 82 proceedings are criminal proceedings and are brought in the tenant(s) local Magistrates Court.
The Court can make an Order for the Landlord to carry out the work required within a specified time period so as to leave the property in such a condition as it is no longer putting the health of the occupant(s) at risk.
In fact, the Court is required to do this if it is proven that conditions within a property are potentially dangerous to health to the occupants.
